Activist files complaint about school board closed meetings David L. Cahn, an Upper Marlboro resident, said the board has frequently violated the Open Meetings Act, a law outlining which government meetings must be open to the public. He filed a complaint Dec. 11 with the state Open Meetings Law Compliance Board citing three board meetings held in the fall. Cahn said the board voted simultaneously instead of one at a time to close meetings, which made it difficult to record their individual votes, as required by the Open Meetings Act. Cahn also claims that charter school policy changes and a non administrative internal audit were discussed privately instead of publicly, and minutes from meetings are not sufficient, as required by law. Andrew W. Nussbaum, the Prince George school board attorney, responded Jan. 17 in writing to the compliance board and said the internal audit discussed was administrative and was a need for continued confidentiality for the audit to be completed. He added that the law does not specify what kind of vote should be taken to close a meeting and said no charter school policy changes were discussed privately. According to the law, meeting minutes must include every item discussed, the action taken and the vote.
